2. Acceptance of Terms

By accessing or using Canopy Mail ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

3. Description of Service

Canopy Mail is a web-based email client that allows you to access and manage your email accounts (Gmail and IMAP) through a unified interface. The Service provides features including but not limited to:

  • Email reading, composing, and sending
  • Email organization (labels, folders, search)
  • Snooze and scheduled send functionality
  • AI-powered email summarization and composition assistance (Pro plan)
  • Keyboard shortcuts for efficient email management

4. Account Registration

To use the Service, you must sign in using a Google account. By signing in, you authorize us to access your email on your behalf according to the permissions you grant. You are responsible for maintaining the security of your account credentials.

5. Email Account Access

When you connect an email account to Canopy Mail:

  • Gmail: We use OAuth 2.0 authentication. We never see or store your Google password. You can revoke access at any time from your Google Account settings.
  • IMAP: Your credentials are encrypted using AES-256-GCM encryption before storage. We use these credentials solely to access your email on your behalf.

We do not store your emails on our servers. Emails remain with your email provider (Google, your IMAP server, etc.).

6. Subscription and Payments

Canopy Mail offers both free and paid subscription plans:

  • Free Plan: Basic email functionality with limited features.
  • Pro Plan: Full access to all features including AI capabilities, available via monthly or annual subscription.

Payments are processed securely through Stripe. By subscribing to a paid plan, you agree to pay the applicable fees. Subscriptions automatically renew unless cancelled before the renewal date.

Right of Withdrawal (EU Consumers)

Under EU consumer protection law, you have the right to withdraw from a digital service contract within 14 days of purchase without giving any reason. To exercise this right, contact us at legal@canopymail.eu with a clear statement of your decision to withdraw.

Important: By using the Pro features immediately after purchase, you acknowledge that:

  • The digital content/service is provided immediately upon subscription
  • You expressly consent to losing your right of withdrawal once the service is fully performed
  • For ongoing subscriptions, you may still cancel at any time for future billing periods

Refund Policy

In addition to your statutory right of withdrawal, we offer a 14-day money-back guarantee for new Pro subscriptions. If you're not satisfied with the Service, contact us within 14 days of your initial purchase for a full refund.

Price Information

All prices displayed are inclusive of VAT where applicable. Current pricing is available on our pricing page. We will notify you of any price changes before your next billing period.

7. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws
  • Attempt to gain unauthorized access to the Service or its related systems
  • Interfere with or disrupt the Service or servers connected to the Service
  • Use the Service to send spam, phishing emails, or other unsolicited communications
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Use automated systems or bots to access the Service without our express permission

8. AI Features

Pro subscribers have access to AI-powered features including email summarization and composition assistance. These features use Claude by Anthropic. When using AI features:

  • Email content is sent to our AI provider for processing
  • AI-generated summaries may be cached (encrypted) to improve performance
  • AI responses are generated automatically and may contain errors
  • You are responsible for reviewing AI-generated content before sending emails

9. Intellectual Property

The Service, including its design, features, and content (excluding your emails), is owned by Canopy Mail and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our express permission.

10. Service Availability

We strive to maintain high availability of the Service, but we do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We will endeavor to notify users of planned maintenance in advance.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, to the extent permitted by applicable law. We do not warrant that the Service will be uninterrupted, error-free, or completely secure.

Note for EU consumers: This disclaimer does not affect your statutory rights under EU consumer protection law, including rights related to non-conformity of digital content or services.

12. Limitation of Liability

To the maximum extent permitted by applicable law, Canopy Mail shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or business interruption, arising out of or related to your use of the Service.

Our total liability for any claims related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

Important: Nothing in these Terms limits or excludes our liability for:

  • Death or personal injury caused by our negligence
  • Fraud or fraudulent misrepresentation
  • Intentional misconduct or gross negligence
  • Any other liability that cannot be limited or excluded under applicable law (including EU consumer protection law)

13. Indemnification

You agree to indemnify and hold harmless Canopy Mail, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the Service or violation of these Terms. This indemnification clause applies to the extent permitted by applicable law and does not apply where prohibited by EU consumer protection regulations.

14. Termination

We may suspend or terminate your access to the Service at any time for any reason, including if we reasonably believe you have violated these Terms. You may terminate your account at any time through the app settings. Upon termination, your data will be deleted as described in our Privacy Policy.

15. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on our website and updating the "Last updated" date. For material changes that affect your rights, we will provide at least 30 days notice before the changes take effect. Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms.

16. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Netherlands.

For EU consumers: You may bring legal proceedings in the courts of your country of residence. Additionally, you have the right to use the European Commission's Online Dispute Resolution (ODR) platform for resolving disputes online.

For other users, any disputes shall be resolved in the courts of the Netherlands.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
